ECCN Classification
If you are exporting goods or technology from the United States, you may need to determine their Export Control Classification Number (ECCN) before shipping them. The ECCN is a five-character alphanumeric code that identifies the type of product and its level of control under the Export Administration Regulations (EAR). Here are some steps for ECCN classification:
- Check if your product is subject to the EAR. Some products are excluded from the EAR, such as publicly available information, certain software and encryption items, and items regulated by other agencies. You can find a list of exclusions in Part 734 of the EAR.
- If your product is subject to the EAR, check if it has a specific ECCN listed in the Commerce Control List (CCL). The CCL is divided into 10 categories and 5 groups, each with a different set of criteria and controls. You can find the CCL in Supplement No. 1 to Part 774 of the EAR.
- If your product does not have a specific ECCN in the CCL, check if it falls under the general ECCN of EAR99. EAR99 products are subject to minimal controls and can be exported to most destinations without a license, unless they are destined to an embargoed country, an end-user of concern, or an end-use of concern.
- If you are unsure about your product’s ECCN or need further assistance, you can request an official classification from the Bureau of Industry and Security (BIS). You can submit your request online through the Simplified Network Application Process Redesign (SNAP-R) system or by email to ECDOEXS@bis.doc.gov.
